    Elon Musk Abruptly Amends $150,000,000,000 OpenAI Lawsuit, Seeks To Direct Damages to Firm’s Charitable Arm: Report

    Elon Musk is moving to redirect any potential payout from his lawsuit against OpenAI away from himself and toward the company’s nonprofit arm.

    Musk has amended his complaint to clarify that he is not seeking personal financial gain, even as he continues to pursue more than $150 billion in damages from OpenAI and its partner Microsoft, The Wall Street Journal reports.

    Musk sued OpenAI in February 2024, claiming that ChatGPT maker has violated its founding mission as a nonprofit research lab dedicated to developing artificial intelligence for the benefit of humanity, not for shareholder profit.

    Says Musk’s lawyer, Marc Toberoff,

    “He is not seeking a single dollar for himself. He is asking the court to return everything that was taken from a public charity—and to make sure the people responsible are never in a position to do this again.”

    The amendment also includes a request that OpenAI CEO Sam Altman be removed from the nonprofit board, along with a demand that Altman and OpenAI president Greg Brockman turn over any equity or financial gains to the charitable entity.

    The lawsuit is expected to go to trial later this month in Oakland, California, marking the latest escalation in a long-running dispute between Musk and OpenAI leadership.

    OpenAI pushes back on the filing, noting that the move is a shift in the narrative rather than substance.

    “Today, at the eleventh hour, Elon lodged a court filing pretending to change his tune about attacking the nonprofit OpenAI Foundation.

    The truth is that this case has always been about Elon generating more power and more money for what he wants. Having increasingly realized that his attempt to damage the nonprofit OpenAI Foundation rests on a baseless legal case, Elon is once again trying to change the narrative and save face as the trial approaches. His lawsuit remains nothing more than a harassment campaign that’s driven by ego, jealousy and a desire to slow down a competitor.”
